Summary & Analysis
This law establishes the Ekiti State Environmental Protection and Watershed Management Agency as a corporate body with powers to sue, hold property, and advise the state on environmental policies. The Agency is governed by a Board and a General Manager, and is responsible for environmental impact assessments, water quality, effluent standards, air quality, noise control, and watershed management (including catchment areas, channel maintenance, and minimum setbacks). It imposes duties such as desilting drains, regulating hydraulic structures, and conducting public consultations. The law creates numerous offences and penalties for illegal dumping, discharge of hazardous substances, pollution, and obstruction of authorised officers, with fines for companies and individuals. It also repeals any inconsistent previous laws and grants powers to shut down polluting facilities, contain pollution, and enforce compliance through court proceedings.
